caret Notice of public hearing/comment concerning the following proposed actions: (1) amend Regulation .01 under COMAR 26.11.01 - General Administrative Provisions, (2) amend Regulations .01, .02, .04, .05, .07, and .08-2, repeal Regulation .08-1, and adopt new Regulation .10 under COMAR 26.11.08 Control of Incinerators; and (3) Amend Regulation .08 under COMAR 26.11.09 Control of Fuel-Burning Equipment, Stationary Internal Combustion Engines, and Certain Fuel-Burning Installations.

The Maryland Department of the Environment gives notice of the following public hearing/comment period: The purpose of this action is to repeal nitrogen oxide (NOx) reasonable available control technology (RACT) requirements under COMAR 26.11.09.08H and establish new NOx RACT and analysis of possible additional NOx emission control requirements under COMAR 26.11.08.10 for large municipal waste combustors (MWCs). Additionally, this action amends opacity requirements under 26.11.01, adds definitions, repeals 26.11.08.08-1 and updates references to 26.11.08.08-2, which is the current emission standards and requirements for hospital, medical and infectious waste incinerators (HMIWIs).

The amendments pertaining to large MWCs will be submitted to the U.S. Environmental Protection Agency (EPA) for approval as part of Maryland's State Implementation Plan (SIP). The amendments pertaining to small MWCs and HMIWIs will be submitted to the EAP for approval as part of Maryland's 111(d) and 129 plans.

The Maryland Department of the Environment gives notice of the following public hearing/comment period: The purpose of this action is to propose new Regulations .01-.04 under new Chapter COMAR 26.11.40 - NOx Ozone Season Emission Caps for Non-trading Large NOx Units - to meet federal NOx SIP (State Implementation Plan) Call requirements under the Clean Air Act. The proposed action will also repeal one definition in Regulation .01 under COMAR 26.11.01 - General Administrative Provisions - and will amend Regulation .07 under COMAR 26.11.14 - Control of Emissions from Kraft Pulp Mills.

This action will be submitted to the U.S. Environmental Protection Agency (EPA) for approval as part of Maryland's SIP.

caret Notice of public comment period to amend regulations Regulation .01 under COMAR 26.12.01 Radiation Protection and Regulation .02 under COMAR 26.12.02 Inspection and Certification.

The Maryland Department of the Environment gives notice of public comment period concerning the following proposed action:

Amend Regulation .01 under COMAR 26.12.01 Radiation Protection and Regulation .02 under COMAR 26.12.02 Inspection and Certification.  The purpose of this action is to (1) update COMAR 26.12.01.01 to (a) establish “diagnostic medical radiation event” and require reporting and recordkeeping of such events; (b) require advance written request for radiation machine facility registration cancellation, and report of removal of x-ray machines; (c) require registration and fee payment for short term demonstration of human use radiation machines; (d) make corrections in regulations controlling transportation of radioactive material, (e) change requirement for examination of radiographer who has not participated in industrial radiography from 3 months to 6 months; and (f) other miscellaneous corrections; and (2) update COMAR 26.12.02.02 to clarify that State certification is inapplicable to mammography diagnostic or screening radiation machines.

The Maryland Department of the Environment gives notice of the following public hearing/comment period: Amendments for Regulations .01 and .04 under COMAR 26.11.17 Nonattainment Provisions for Major New Sources and Major Modifications. The purpose of this action is to amend COMAR 26.11.17 to allow interprecursor trading of ozone precursors, NOx and VOC.

caret Notice of public hearing/comment concerning the following proposed regulations under Maryland's CO2 Budget Trading Program: (1) Amend Regulation .02 under 26.09.01 General Administrative Provisions; and (2) Amend Regulations .08 and .09 under COMAR 26.09.02 Applicability, Determining Compliance, and Allowance Distribution.

The Maryland Department of the Environment gives notice of the following public hearing/comment period. The primary purpose of this action is to revise the Maryland CO2 Budget Trading Program to incorporate amendments to the Voluntary Renewable Set-Aside Account (VRSA), codified under COMAR 26.09.02.08, and the Clean Generation Set-Aside Account (CGSA), codified under 26.09.02.09. This action will also add two new definitions under 26.09.01.02.

This action will not be submitted to the U.S. Environmental Protection Agency (EPA) for approval as part of Maryland's State Implementation Plan (SIP).

caret Notice of public hearing/comment period concerning the following proposed action: COMAR 11.14.08 Vehicle Emissions Inspection Program

The Maryland Department of the Environment and the Motor Vehicle Administration give notice of the following public hearing/comment period. 

The Secretary of the Environment and the Administrator of the Motor Vehicle Administration jointly propose to amend Regulations .01, .03—.05, and .09 under COMAR 11.14.08 Vehicle Emissions Inspection Program. The purpose of this action is to modernize and enhance the Vehicle Emissions Inspection Program (VEIP) to improve motorist convenience while minimizing the impact on air quality. This action delays the initial VEIP inspection date for new vehicles and exempts pre-on board diagnostics (OBD) light duty vehicles from inspection. These enhancements improve customer service, and allow Marylanders to benefit from recent air quality progress in the State. In addition, this action corrects an obsolete statutory reference and a typographical error. 

This action will be submitted to the U.S. Environmental Protection Agency as a State Implementation Plan Revision.

The Maryland Department of the Environment gives notice of the following public hearing/comment period. The purpose of this action is to amend existing requirements for emergency generators and load shaving units (engines) codified under COMAR 26.11.36 — Distributed Generation to reflect changes in the federal requirements for stationary internal combustion engines (ICE) and Reciprocating Internal Combustion Engines (RICE) (hereinafter collectively referred to as “stationary engines”). In addition, changes to Regulations .01 — Definitions, and .10 — Sources Exempt from Permits to Construct and Approvals, of COMAR 26.11.02 – Permits, Approvals, and Registration, are being completed to coincide with the amendments being made to COMAR 26.11.36. 

The regulatory action listed above will not be submitted to the U.S. EPA as revision to Maryland's State Implementation Plan at this time.

caret Notice of public hearing/comment period concerning the following proposed action: Repeal of COMAR 26.11.09.11 - Control of Particulate Matter from Small Wood Boilers.

The Maryland Department of the Environment gives notice of the following public hearing/comment period. The purpose of this action is to repeal existing Regulation .11 under COMAR 26.11.09 as there are new federal rules in place regulating residential hydronic heaters under 40 CFR Part 60, Subpart QQQQ.  Repealing Maryland’s small wood boiler regulation will remove any conflict that currently exists between the existing regulation and the federal regulation. The Department also proposes to amend Regulations .01, .04 and .06 under COMAR 26.11.09 Control of Fuel-Burning Equipment, Stationary Internal Combustion Engines, and Certain Fuel-Burning Installations to clarify definitions and references to the repealed regulation.
